Unless there's updated news, I don't think the modder was arrested, just charged.
Unless the American legal system is rather different than I understand it, I don't think you can be charged without arrest.
actually, a person can be 'charged' before being arrested here in the usa, i think. a grand jury can hand down an indictment, which is a 'charge', and the subject can then be arrested and formally charged. i expect someone with much more legal expertise will comment.

He was indicted in August and arrested on Oct. 23. They waited until after his arrest to unseal the indictment.
