Wouldn't he also have to get permission from the original photographer if he wants to do the whole legal thang?

Yeah, I had to reread that to be sure too, I suspect because I was so surprised by the implication. That being that Joi Ito took the original photo of Lucas and Abrams. Someone else photoshopped in the phaser and light saber. But rather than wanting to sue the photoshopper into a grease spot and have him forever banned from using anything with a microprocessor in it, Ito considers the resulting photo a valid derivative work and the property of the photoshopper, such that he'd have to have permission to use it himself.
Pretty amazing, huh?
