This is amazing, I actually noticed a small grocery store here in Lund, Sweden where Tux is the main logo. I'll try to get down to the store tomorrow (it's 7pm here now) and return with a photo.

That's actually a pretty bad copyright violation.
I assume the image is copyrighted even though it's an open source project.
Well, this is a convenience store that is frequented by plenty of linux-friendly individuals from the University of Florida. We're amused, in general, by the concept of penguins down here.
Still, knowing of a copyright violation makes a copyright holder responsible for enforcing the copyright else it can be stated that consent was given through inaction. So TUX has to be enforced as a copyright else lose him as our mascot for good.
I believe you're confusing copyright with trademark. I don't think copyrights need active defense in order to remain in effect.

Tux is a mascot, not a logo. Quoth his creator: "Permission to use and/or modify this image is granted provided you acknowledge me lewing@isc.tamu.edu and The GIMP if someone asks."

Haha! I saw a store here in Singapore using the rounder version of Tux as their mascot a few months back. I took a small photo of it and posted it on my blog.

I looked it up at the time and it seems you can use it so long as you get permission from the creator.
Which gas station is this? I'm a UF student too, would like to go laugh at it if it's somewhere nearby.

ther's a non-stop in hungary, wich goes by the name pingvin (pinguin) and uses Tux as it's new logo recently.
No you have to defend copyrights as well or else everyone can be turning the Microsoft Windows logo into a Nazi symbol (been their done that and got nailed for copyright infringement).
